NOTICE OF PUBLIC HEARING
CITY OF CHUBBUCK, IDAHO

NOTICE IS HEREBY GIVEN that the Land Use & Development Commission of the City of Chubbuck, Idaho, will conduct a Public Hearing at 6:00 pm on September 12, 2023 at Chubbuck City Council Chambers, 290 East Linden Ave., Chubbuck, Idaho. Public hearings will be held with respect to the following items:

  1. An application for a Conditional Use Permit for a duplex at 200 Stuart Drive in the Limited Residential (R-2) zone in Chubbuck, Idaho. The site comprises approximately .25 acres of land, designated by the Comprehensive Plan Future Land Use Map for Medium Density Residential development. The application will be reviewed against criteria in section 18.28.020.C.5 of City Code. Type of action: Decision.

Written testimony must be received by jbowers@cityofchubbuck.us at least 7 days prior to the hearing, shall comply with standards established in City resolution 2021-06. A complete description of each item is available to the public on request to jbowers@cityofchubbuck.us. Commission packets are generally available the week before the meeting at https://cityofchubbuck.us/land-use-commission/ or are available by contacting the City Clerk. Any and all persons may register comments, protests, or agreements on the hearing subjects being considered. Oral testimony concerning these proposals may be offered at the public hearing. Commission may limit oral testimony.

Proposed Supplemental Termination Budget for Chubbuck Downtown Improvement Plan District Only for Fiscal Year 2023

A public hearing for consideration of the proposed Supplemental Urban Renewal Agency Project budget for the fiscal year that begins October 1, 2022, and ends September 30, 2023 will be held in Council Chambers, located at 290 E. Linden Ave, Chubbuck, Idaho, on September 19, 2023, at 5:30 p.m., pursuant to Idaho Code §§ 50-2903(5). Written or oral comments about the proposed budget are welcome.  Written comments may be submitted prior to the meeting to:  Chubbuck Development Authority, c/o Devin Hillam, 290 E Linden Ave., Chubbuck, ID 83202.

The Agency budget funds the programs, services, and capital projects that the Agency Board and the City Council have determined to be important to meet the Agency’s strategic goals as described in the adopted urban renewal plans. Agency does not levy property taxes but rather, collects increment revenues generated in accordance with the urban renewal plans.

Prior year revenues and expenditures are available on the full Agency published supplemental budget proposal for FY 2023. City Hall is accessible to persons with disabilities.

Budget Note:

The Agency expects that all financial obligations related to the Project Area will have been provided for, and any outstanding obligations will be paid in full on or before September 30, 2023, with the exception of: any reimbursement agreements or notes that have expired, terminated or cancelled on their own terms; project cost overruns from current projects; project costs for unexpected construction delays; and costs related to monitoring compliance of development occurring pursuant to the terms of a DDA. The Agency will have sufficient funds on deposit for payment of the final project costs, Agency operations and administrative fees and costs.

The Agency owns certain real property in the Project Area as identified by address below. The Agency intends to dispose of three (3) parcels to developers selected pursuant to a competitive selection process as outlined in Idaho Code § 50-2011. For each parcel, the Agency and developer have entered into an agreement to negotiate exclusively and are currently negotiating the terms of a DDA. Should the property transfers fail to close pursuant to the DDAs, the Agency will convey the parcels to the City for disposal. The properties’ approximate addresses are 152 Evans Ln., 206 E. Linden Ave., and 339 E. Chubbuck Road, Chubbuck, ID 83202.

NOTICE IS HEREBY GIVEN that the Land Use & Development Commission of the City of Chubbuck, Idaho, will conduct a Public Hearing at 6:00 pm on August 8, 2023 at Chubbuck City Council Chambers, 290 East Linden Ave., Chubbuck, Idaho. Public hearings will be held with respect to the following items:

  1. An application for initial designation of property into the Limited Residential (R-2) Land Use District (zone) that is proposed to be annexed into the City of Chubbuck. The subject property comprises approximately 22.67 acres of land located at the northwest corner of Philbin Road and Angela Street in Chubbuck, Idaho. At the meeting, the Commission will consider whether the proposal satisfies the approval criteria in municipal code section 18.28.050.B. Type of Action: Recommendation.
  2. An application to update several sections of Chubbuck City Code: Title 18, Land Use, regarding the height limits of architectural features and various monuments, and height of buildings in the Village and Highway Corridor land use districts; and Title 15, Buildings and Construction, regarding the height, width, and placement of signs, and clarifying standards for temporary signs. Type of Action: Recommendation.

Who is responsible for maintaining sidewalks?

Who is responsible for maintaining sidewalks? It is ultimately the property owner’s responsibility to maintain the sidewalks regardless of who installs them (City Code 8.28.030).

• If the sidewalk adjoins private property (Front, Side, or Back of the Property), property owners have the responsibility to maintain and keep the sidewalks clear of weeds and snow.
